Quick Answer
A Certificate of Legal Capacity to Contract Marriage is the evidence a foreign applicant generally needs under Article 21 before obtaining a Philippine marriage licence. It is normally issued through the applicant’s diplomatic or consular authority, although specific official arrangements recognise other documents. The accepted route depends on nationality and, in some cases, country of residence.
It is a pre-marriage document. It is not the marriage licence, the certificate signed at the wedding or a PSA marriage certificate.
What is the document meant to establish?
The foreign applicant must establish that there is no relevant legal impediment to the intended marriage. The Philippine licence process needs the evidence accepted under the applicable Article 21 arrangement.
Not every country maintains a central marriage register or issues an individual certificate with the Philippine document’s exact name. A Certificate of No Impediment, an embassy certificate and a Statement in lieu can therefore appear in different official procedures.
The names should not be treated as interchangeable. What matters is the issuer, the document’s purpose and compliance with the arrangement applicable to the applicant.
Who needs it?
The requirement applies when either or both applicants are foreign citizens. If both are foreign nationals, each must establish their own capacity; sharing a nationality does not remove either person’s obligation.
For example, Canada expressly requires a separate Statement for each Canadian partner. The Australian Embassy likewise requires separate applications where both partners are Australian citizens or permanent residents using its CNI service.
Our guide to two foreign nationals marrying in the Philippines explains how the two applicants’ evidence fits into the same proposed marriage.
Article 21 also provides a specific alternative for stateless persons and refugees: an affidavit stating the circumstances showing their capacity to marry. That statutory provision should not be extended to every ordinary foreign citizen whose embassy uses a different document name.
How the principal documents differ
| Document | Purpose in the marriage process | What it does not replace |
|---|---|---|
| Accepted legal-capacity evidence | Meets the foreign applicant’s applicable Article 21 documentary route | The marriage licence and other eligibility checks |
| CENOMAR | Reports the outcome of a Philippine marriage-record search | The nationality-specific foreign legal-capacity requirement |
| Marriage licence | Authorises the intended marriage within its statutory validity, unless an exemption applies | The actual ceremony and declarations |
| Marriage certificate | Records the marriage that has taken place | The pre-marriage requirements that should already have been satisfied |
A Philippine record search is not a worldwide search of every registry. The guide to CENOMAR versus a legal-capacity certificate explains the distinction, while CENOMAR requirements for foreigners addresses when that additional record may be relevant.
Nationality and residence determine the route
British applicants
PSA Memorandum Circular No. 2023-23 distinguishes British nationals residing in the UK from those resident elsewhere.
UK residents must provide an apostilled CNI issued by their UK local registrar. British nationals residing in the Philippines or another country outside the UK follow the applicable Affidavit of Freedom to Marry procedure before the British Embassy in Manila.
For the consular declaration procedure, the form is prepared in advance but signed at the appointment. A short visit should not be assumed to change the residence category governing the document route. The British citizen guide is the country-specific continuation.
Australian applicants
The Australian Embassy in Manila issues a CNI. The applicant needs an appointment, personal attendance, the appropriate identity evidence and supporting civil-status records. Australian citizens present a current Australian passport.
An intended spouse who is neither Australian nor an Australian permanent resident is not required to attend that CNI appointment. That does not remove any separate attendance obligation at the Philippine licence application.
Acceptance of a CNI obtained in Australia must be established before relying on it. The Australian citizen guide covers that documentary route in more detail.
Canadian applicants
Canada does not issue an individual certificate certifying that a citizen is legally capable of marrying. Its embassy in Manila provides a Statement in lieu, supported by a notarised statutory declaration and the relevant records.
The declaration is part of that procedure, rather than a universal permission to substitute any locally notarised affidavit. The embassy also warns that some Philippine registrars may not accept the Statement, making advance acceptance material to the intended application.
The Canadian citizen guide is the appropriate continuation for the supporting records and submission arrangements.
German applicants
German applicants first obtain an Ehefähigkeitszeugnis from the competent German civil registry. The Philippine application also requires the German Embassy’s consular legal-capacity certificate.
These are distinct stages. The German citizen guide addresses the country-specific process.
What supporting records may be needed?
The issuing authority may need evidence of:
- Identity and citizenship.
- Birth details.
- Present residence.
- The intended spouse’s details.
- The termination of previous marriages or a former spouse’s death.
- Any other matter relevant to the applicant’s capacity.
The exact list depends on the route. A certificate issued without the records required by that procedure should not be assumed acceptable simply because its heading sounds correct.
Any previous marriage must be disclosed accurately. A foreign divorce document can raise separate recognition or registry questions; receiving a consular document should not be treated as resolving every such question automatically.
When should you obtain the document?
Work backwards from both the application and ceremony dates. Allow time for obtaining underlying records, authentication where applicable, an appointment and issue or delivery.
There is no universal validity period for every nationality:
| Official example | Timing guidance |
|---|---|
| Australian CNI | The embassy states that Philippine authorities normally do not accept one issued more than six months before marriage |
| Canadian Statement in lieu | No validity period is stated on the document, but a registrar may reject one issued more than six months earlier |
| Other nationality-specific documents | Apply the particular issuing and receiving requirements; do not borrow another country’s period |
The licence’s separate 120-day validity does not extend the acceptable age of a supporting document.
Does the certificate need an apostille?
The answer depends on what document it is and who issued it.
The British UK-resident route expressly requires an apostilled UK-issued CNI. By contrast, the Apostille Convention excludes documents executed by diplomatic or consular agents from its scope. An embassy-issued document should not automatically be processed as though it were an overseas civil registry certificate.
An apostille authenticates specified aspects of a qualifying document’s origin. It does not establish the truth of every statement, translate the record or independently decide whether the holder may marry.
Before the licence application
- Identify the applicant’s nationality and actual country of residence.
- Establish the applicable certificate or accepted alternative.
- Prepare the supporting identity and civil-status records.
- Complete any required personal declaration or consular appointment.
- Establish the receiving registrar’s acceptance of the document.
- Check timing, copies, translation and any required authentication.
- Keep the certificate with the rest of the applicant’s licence file.
Legal-capacity questions
Can we marry as soon as the certificate is issued?
The document supports the licence application. It does not dispense with the competent registrar, public posting where required, the licence itself or the legal ceremony.
What if the embassy does not issue a certificate with this exact name?
Some official nationality-specific arrangements use alternatives. Follow the recognised route applicable to the applicant; the absence of a particular title does not create a general right to use any affidavit.
Can a wedding organiser issue the certificate?
An organiser cannot assume the powers of a consular or other competent issuing authority. Private assistance can coordinate preparation, while the required official document or declaration must come through the proper procedure.
