Quick Answer

Yes, but only where a specific legal exemption genuinely applies. The Family Code provides limited exceptions to the marriage-licence requirement; it does not allow a couple to dispense with the licence simply because they want an urgent, inexpensive or private ceremony. The legal facts must support the particular exemption.

An exemption from a licence is not an exemption from marriage eligibility, consent or every ceremony and registration requirement.

The table identifies categories, not a menu from which a couple can choose the most convenient description.

The authorised-officer guide explains why a person’s professional title alone does not grant unlimited authority to conduct an exceptional marriage.

Five-year cohabitation is a factual requirement

Article 34 concerns a man and woman who have lived together as husband and wife for at least five years without a legal impediment to marry each other.

The period is not simply five years since first meeting, dating or becoming engaged. It must be the legally qualifying cohabitation, not a relationship reconstructed to fit an affidavit.

Supreme Court decisions emphasise continuity, exclusivity and the years immediately preceding the wedding. In Republic v. Dayot, a false claim to the qualifying period could not replace the missing licence.

If an earlier marriage remained an impediment during the relevant history, living together with a new partner does not automatically satisfy the exemption.

What does the affidavit do?

The parties state the qualifying facts under oath. The solemnising officer must also make the required sworn statement that the qualifications were ascertained and no legal impediment was found.

The affidavit records evidence of an existing qualification. It does not create five years that did not happen.

An organiser cannot turn a short relationship into a qualifying one by supplying a standard form. Nor should a couple sign a statement that they know describes the wrong dates or circumstances.

A private agreement between the applicants cannot waive a statutory condition.

Point-of-death and remote-residence cases are narrow

Article 27 permits a qualifying marriage at the point of death without a licence, even if the party later survives. That is different from claiming urgency because a flight leaves soon.

Article 28 concerns a residence so situated that there is no means of transportation enabling the party to appear before the registrar. Being busy, living abroad or finding a journey inconvenient is not the same condition.

The Code requires the officer’s supporting affidavit in the specified exceptional circumstances. The legal basis and facts must be accurately recorded.

The reporting requirements also differ: the PSA identifies a thirty-day reporting period for licence-exempt marriages, distinct from the ordinary fifteen-day period.

Customary and Muslim-law situations need their own framework

Article 33 addresses specified marriages among Muslims or members of ethnic cultural communities according to their customs, rites or practices.

The Code of Muslim Personal Laws has its own scope and conditions. A person cannot assume that adopting a label or selecting an imam removes every ordinary requirement.

Later legislation prohibiting child marriage must also be respected. An old customary or religious practice cannot be used as a general route to marry a child.

Where an exceptional framework applies, identify the authorised officer, valid participation and correct registration route for that marriage.

What requirements do not disappear?

The couple must still have the relevant legal capacity and freely consent. The actual ceremony, witnesses and marriage record must comply with the applicable law.

Age-related questions remain important. Our guide to parental consent and parental advice explains why a licence-related difficulty should not be answered with an invented exemption.

The exemption is also different from a proxy ceremony. A statement that no licence is needed does not automatically remove personal participation.

The licence-application attendance guide concerns the ordinary route; do not confuse an exemption from that licence process with permission for someone else to marry for you.

If no exemption clearly fits

Use the ordinary marriage-licence procedure. Resolve the competent registrar, documents and attendance, then allow for the statutory notice period.

A short visit is a planning constraint, not a legal category of exemption. The same is true of wanting to keep the ceremony quiet or reduce costs.

Where a licence is legally required, a certificate registered after the wedding does not itself supply the missing pre-marriage authority. Registration and validity are different questions.

Check before relying on an exemption

  • Identify the exact statutory or applicable personal-law basis.
  • Establish the actual dates and circumstances.
  • Disclose earlier marriages or other impediments.
  • Obtain the required truthful sworn evidence.
  • Confirm that the officer has authority in that situation.
  • Arrange the lawful ceremony and witnesses.
  • Establish the appropriate reporting and registration deadline.

Exemption questions

Does having a child together prove the five-year exemption?

It does not by itself establish the duration, continuity or absence of legal impediment required for Article 34.

Can we buy an affidavit instead of waiting for a licence?

A document cannot replace facts that do not satisfy the law. Use the ordinary route if the exemption is unavailable.

Is every hospital wedding licence-exempt?

No. A hospital location alone does not establish a point-of-death case or another exemption.

Does an exemption mean the marriage does not need registration?

No. The applicable reporting and civil-registration requirements still need to be completed.
