Quick Answer

A US citizen can marry in the Philippines if both partners meet the applicable legal conditions and complete the Philippine marriage process. An American applicant must establish legal capacity, but the US government does not issue a general official certification of an individual’s marital status. A sworn affidavit is used to address that evidential gap through an accepted procedure.

The important preparation task is to establish which affidavit, supporting records and execution method the receiving Philippine registrar will accept. A downloaded form alone does not complete that step.

Why the American document is different

Article 21 of the Family Code generally requires foreign applicants to submit a certificate of legal capacity issued through their diplomatic or consular authority before a Philippine marriage licence can be obtained.

The US Department of State explains that the US government cannot attest to an individual’s marital status. Its guidance describes a written statement affirming eligibility to marry as evidence that may be used where foreign authorities request such certification.

The Philippine Embassy in Washington publishes an Affidavit in Lieu of Certificate of Legal Capacity to Contract Marriage for American Citizens. Its official forms directory also lists this document.

These sources establish the purpose and existence of the American affidavit. They do not establish that every locally notarised declaration, every overseas notary or every version of the form is accepted by all Philippine registrars.

Our legal-capacity document guide explains the wider nationality-specific framework.

What the published American affidavit asks you to declare

The Philippine Embassy’s form identifies the applicant through their name, US passport, state of legal residence and Philippine address. It also asks for a declaration that the applicant has never married or that all previous marriages have been legally terminated.

Prepare the factual history before arranging the oath:

What the published American affidavit asks you to declare
InformationSupporting preparationMistake to avoid
Name and US citizenshipCurrent passport and consistent personal particularsUsing a name unsupported by the identity file
State of legal residenceAccurate present legal-residence informationTreating any mailing address as the relevant residence
Address in the PhilippinesThe actual address applicable to the declarationAssuming the address automatically establishes licence jurisdiction
Never-married statusA complete and truthful marriage historyOmitting an earlier marriage because it occurred overseas
Previous marriages terminatedFinal termination or death records for the relevant marriagesRelying on separation or a divorce proceeding that is not final

An affidavit records the applicant’s sworn statements. Notarisation of the signature does not turn it into a worldwide government search of marriage registers.

If a Philippine CENOMAR is also requested, it has a different purpose. Our guide to CENOMAR requirements for foreign applicants explains why the two records should not be treated as substitutes.

Establish the accepted execution procedure before signing

Settle acceptance with the receiving registrar

Give the registrar your nationality, actual residence, intended partner’s details and any previous-marriage history. Establish the precise affidavit and supporting records required for your application.

Ask which official must administer the oath, whether an original is required and whether authentication is needed for the proposed place and method of execution.

Do not assume that an American affidavit sworn in the United States, one notarised locally in the Philippines and one made before a US consular officer have identical acceptance requirements.

Arrange any required official appointment

The State Department’s general guidance explains that where a statement is notarised at a US embassy or consulate, an appointment is needed. That general instruction does not establish the current Manila or Cebu booking arrangements, available service locations, fee or release time for a Philippine marriage-related affidavit.

Obtain the current requirements for the service you will actually use before planning attendance. Leave a declaration unsigned if it must be signed before the administering official.

A private service provider cannot take the oath on your behalf or promise that a particular registrar will accept an incorrectly executed document.

Build the rest of the application around both partners

The American affidavit is only one component of the marriage file. Each partner needs their own identity, civil-status and other applicable evidence.

If the intended spouse is Filipino, prepare their Philippine records and any required parental, counselling or previous-marriage documents. If the spouse is another foreign citizen, establish that person’s separate legal-capacity route.

For the American applicant, the relevant preparation may include:

  • Passport and any identity or travel records required by the receiving offices.
  • Birth and personal-particular records required for the licence file.
  • The accepted legal-capacity affidavit and its supporting documents.
  • Final divorce, annulment or former-spouse death records where applicable.
  • Records connecting earlier and current names.
  • Accepted authentication and English translations where required.
  • The local instruction or counselling certificates applicable to the couple.

This is a preparation framework, not a claim that every registrar uses an identical additional-document checklist. The general marriage requirements explain how the two individual files come together.

Previous marriages and US state records

A prior marriage must have ended legally before a new marriage can proceed. Prepare final records showing the relevant divorce, annulment or death; an unsigned settlement or separation is not proof that a marriage has ended.

American records may come from different state or local authorities. Identify the proper issuing office and the accepted certified copy, rather than assuming a federal authority issues every civil-status document.

If an earlier marriage record and a final divorce order use a different surname from the current passport, retain the documents connecting the names. Repeated marriages can require more than the latest page of the history to explain the chain.

Any Philippine recognition or civil-registration issue depends on the actual marriages, citizenship history and documents. Do not assume that every foreign divorce follows the same procedure simply because one applicant is American.

Authentication depends on where and how the record was issued

For qualifying US public documents used in the Philippines, an apostille may be the applicable authentication route under the Apostille Convention. The competent authority depends on the document and its issuing jurisdiction.

The apostille authenticates the relevant signature, capacity and seal or stamp. It does not establish freedom to marry, make a non-final divorce final or translate the document.

Documents executed by diplomatic or consular agents are excluded from the Convention’s scope. An embassy-executed declaration should therefore not automatically be treated as though it were a state-issued US civil record. Our guide to apostilles for foreign marriage documents explains the distinction.

Keep the Philippine timetable separate from consular preparation

The ordinary licence application is made to the competent local registrar by reference to either applicant’s habitual residence. Each party’s sworn application, the required documents and applicable instruction or counselling must be addressed.

For two visiting foreigners, the application route must be established on the actual residence facts. There is no general rule in the Family Code that every tourist may file in any chosen municipality.

The statutory notice is posted for ten consecutive days. This is not a promise that arrival, affidavit execution, application, licence issue and wedding will all be completed within ten days.

An issued licence is valid throughout the Philippines for 120 days. The wedding must still take place through a legally authorised solemnising officer and the prescribed ceremony. US embassy and consulate staff do not perform marriages abroad.

Your American applicant’s planning checklist

  1. Identify the appropriate Philippine registrar and establish the basis for applying there.
  2. Obtain its accepted American affidavit and execution requirements.
  3. Prepare accurate residence details and the complete previous-marriage history.
  4. Obtain the required certified civil records and resolve name inconsistencies.
  5. Arrange any necessary authentication before travelling with the file.
  6. Establish the current appointment, identification and signing requirements for any official service.
  7. Coordinate both partners’ local certificates, applications and attendance.
  8. Allow time after the ceremony for registration and certificate availability.

The certificate and any later US application

The ceremony record must go through Philippine civil registration before the corresponding PSA record can be obtained. The guide to getting a PSA marriage certificate after the wedding explains that separate stage.

US recognition of a foreign marriage depends on the relevant law, including the law of the state where recognition is sought. A marriage certificate also does not automatically grant a spouse a US visa, immigration status or citizenship.

Prepare the records for the particular receiving process. Our guide to Philippine marriage documents for a spouse-visa application distinguishes the marriage evidence from the later immigration decision.

US citizen questions

Is there a single federal US certificate proving I am unmarried?

The State Department states that the US government cannot attest to an individual’s marital status. Do not confuse an available state or county record search with a universal federal legal-capacity certificate.

Does the official affidavit form guarantee approval?

No. Its contents must be truthful, its execution must be accepted and the supporting evidence must meet the applicable requirements. The form itself is not the marriage licence.

Can I arrange a wedding at the US Embassy?

US embassy and consulate staff do not perform marriages abroad. The Philippine marriage must use an authorised solemnising officer under the applicable Philippine procedure.
