Quick Answer

Apply to the local civil registrar of the city or municipality where either partner habitually resides. That is the ordinary rule in Article 9 of the Family Code. The place where you want the ceremony or reception does not automatically determine the application office.

The licence office, solemnising office and office registering the completed marriage can therefore be in different locations. Knowing which office handles which task prevents documents and enquiries being sent to the wrong place.

Start with either partner’s habitual residence

The rule allows the application to be connected to either applicant’s habitual residence. It does not require the couple to hold the ceremony there.

Establish the facts of each person’s residence before comparing local appointment systems. A passport’s nationality, a family connection to a town or a hotel reservation is not, on its own, an answer to the jurisdiction question.

If the facts point to more than one possible office because the partners habitually reside in different places, establish the appropriate application arrangement before filing. Avoid starting duplicate applications simply to see which office will issue a licence first.

Start with either partner’s habitual residence
SituationWhat to establish
One partner habitually resides in a Philippine city or municipalityWhether that residence identifies the competent local registrar and what supporting information is required
Partners habitually reside in different Philippine locationsWhich competent office will process the intended application
A Filipino partner works abroadThe actual residence position; overseas employment alone does not settle every residence fact
Both partners normally live overseasWhether there is a lawful application route and which registrar has authority
The preferred wedding venue is elsewhereCeremony arrangements separately from licence jurisdiction

The table is a way to organise enquiries. It does not create a new residence test or an automatic entitlement in a disputed case.

Two foreign visitors need more than a preferred destination

Philippine official guidance confirms that two foreign nationals can marry under Philippine law, subject to the applicable requirements. It does not mean that tourists may select any municipality for the licence application.

When neither applicant appears to have habitual residence in the Philippines, the competent office and lawful route require case-specific determination. No universally sufficient number of hotel nights can be inferred from Article 9.

For the separate documentary obligations, see two foreigners getting married in the Philippines. Establishing both partners’ legal capacity does not, by itself, establish the issuing registrar’s jurisdiction.

What residence information might be relevant?

Article 11 requires each sworn application to state present residence and citizenship. Published local procedures may request additional supporting evidence.

For example, Naga, Cebu describes its marriage-licence service as available to couples where either or both applicants are city residents, and its checklist includes a barangay residency certificate or voter’s certificate. That is a local example, not proof that identical documents are mandatory everywhere.

The Family Code also states that applicants and their parents or guardians are not required to exhibit their residence certificates in securing the licence. Do not assume that a document called a community tax certificate, a barangay address record and a legal determination of habitual residence are interchangeable. Where a checklist appears inconsistent with the statutory requirement, the required document and its legal basis need clarification.

Use accurate information. A temporary address should not be presented as an established habitual residence merely to make an application appear convenient.

The offices you may encounter

The offices you may encounter
Office or personMain role in an ordinary marriage
Local civil registrar competent under Article 9Receives the licence application and handles assessment, posting and issuance
Embassy, consulate or other competent foreign authorityProvides the foreign applicant’s required legal-capacity documentation under the applicable arrangement
Authorised solemnising officer and their officeHandles the legal ceremony and related arrangements
Registrar where the ceremony takes placeReceives the completed marriage record for local registration
Philippine Statistics AuthorityMaintains civil registration records and issues available PSA copies

A document issued by one of these bodies does not necessarily complete the task assigned to another.

Can the ceremony be held in a different municipality?

An issued licence is valid throughout the Philippines for 120 days from its date of issue. You can therefore have a competent registrar issue the licence and arrange the ceremony elsewhere within that validity period.

The officer conducting the ceremony must still have authority at the proposed location, and the venue must satisfy the applicable rules. A licence’s nationwide validity does not give a particular judge or religious officer unrestricted territorial authority.

Our Civil Marriage guide explains the officer and venue requirements. The separate guide to marriage-licence validity covers the period in which the licence must be used.

How to establish the right office before applying

Prepare a short factual account containing:

  • Both partners’ citizenship and actual residence circumstances.
  • The intended marriage date and ceremony location.
  • Any previous marriage.
  • Ages and any relevant consent or counselling requirements.
  • Whether either partner will need consular appointments in the Philippines.

The registrar then needs the documents relevant to its role, rather than a general wedding itinerary. Establish its application arrangements, required attendance and the point at which the formal process begins.

The guide to attendance at the marriage-licence application helps identify which steps cannot be completed by a local helper. The public posting and waiting-period guide explains how timing follows a properly initiated application.

Questions about application location

Does the PSA issue the marriage licence?

The ordinary licence is issued through the competent local civil registrar. A PSA CENOMAR or birth certificate is supporting evidence, not the marriage licence itself.

Can the mayor’s office handle everything?

A mayor may have authority to solemnise a marriage, but the licence application remains a distinct registrar function. A shared municipal building or combined booking system does not merge those legal responsibilities.

Is the issuing office also where we register the marriage afterwards?

Not necessarily. Article 23 directs the completed marriage record to the registrar of the place where the ceremony was solemnised. That may differ from the office that issued the licence.
