Quick Answer
A Philippine marriage licence is valid for 120 days from its date of issue and can be used anywhere in the Philippines. Under Article 20 of the Family Code, it is automatically cancelled at the end of that period if unused. The licence must show its expiry date prominently.
The relevant event is the marriage ceremony. Booking a venue, paying a supplier or starting a certificate request does not count as using the licence.
Read the issued document first
Check the issue date, the stamped expiry date, both applicants’ details and the licence number when collecting it.
If a date or name appears incorrect, establish the correction with the issuing registrar before the ceremony. Do not alter the document yourself or ask the officer to ignore a discrepancy.
| Date or event | What it means |
|---|---|
| Application or enquiry | Does not start the 120-day validity of an unissued licence |
| Statutory posting | An earlier application requirement |
| Date of issue | The statutory starting point for licence validity |
| Stamped expiry | The date to check against the proposed ceremony |
| Actual ceremony | The event for which the licence must be usable |
| Registration and PSA availability | Subsequent record stages, not a renewal of the licence |
Use the actual stamped dates rather than an estimate such as “about four months”. Calendar months have different lengths.
The 120 days are not the waiting period
The marriage-licence notice period concerns posting before issue. Validity concerns how long the issued licence can be used.
A couple should not count the posting period as part of an already issued document’s life, nor assume the 120 days begin with an online pre-application.
Other preparation can take place before issue. Once the licence is issued, plan the ceremony within the remaining window while allowing for appointments, travel and venue availability.
Can it be used in another city?
Article 20 gives the issued licence nationwide validity. A couple does not ordinarily need a new licence merely because the ceremony is in another Philippine city.
That does not mean the original application could have been made anywhere. The application-location guide explains the separate habitual-residence rule.
The chosen officer must also be authorised to solemnise the marriage at the proposed location. A judge’s territorial authority and the ceremony’s lawful venue are not enlarged by the licence’s national validity.
What happens if the wedding is postponed?
The new date remains within validity
Check the new date against the licence and coordinate it with the officer. Correct any ceremony paperwork already prepared for the earlier date.
Moving a booking does not change the licence’s issue or expiry date. Keep a margin for unforeseen disruption instead of relying on the final available day.
The new date falls after expiry
An unused licence is automatically cancelled when the statutory period expires. Start the required process for a fresh licence rather than expecting a private extension or amended venue contract to preserve it.
Establish which supporting records remain acceptable and which need updating. A fresh licence application is not necessarily a reason to replace every enduring civil certificate, but time-sensitive capacity evidence and searches need separate consideration.
Our guide to changing the wedding date or venue addresses the practical arrangements.
What if the paper is lost?
Losing the document and allowing its legal validity to expire are different problems.
Report the loss to the issuing registrar and establish the official evidence or replacement procedure it accepts. A photograph on a phone should not be assumed sufficient for the officer conducting the ceremony.
A replacement or certified record of the same licence does not automatically create another 120-day period. The original issue and expiry remain material unless a genuinely new licence is issued through the appropriate procedure.
Supporting documents have their own timing
The licence’s validity does not renew a CNI, consular statement or marital-status search.
If a foreign document must be sufficiently recent at the wedding, an otherwise unexpired licence does not override that condition. Check both the licence and each time-sensitive supporting document when rescheduling.
The wedding-day document guide explains which issued documents and identity records should be ready for the officer.
Does the licence need to remain unexpired until PSA registration?
The 120-day rule concerns using the licence for the marriage. Registration after a ceremony conducted while the licence was valid is a separate administrative stage.
Ordinary transmission of the marriage certificate follows the Family Code’s reporting requirements. The fact that the licence’s expiry later passes does not turn a subsequent PSA certificate order into a new wedding.
If no ceremony took place before expiry, registration cannot be used to make an unused licence count as used. The marriage record must state the true ceremony date.
A date check before confirming suppliers
- Obtain the actual issue and expiry dates.
- Confirm the intended ceremony is within validity.
- Establish the officer’s authority for the chosen place.
- Review supporting-document recency.
- Keep enough time for an official response if a document is lost or incorrect.
- Recheck the window whenever the date changes.
Validity questions
Does the licence expire after four calendar months?
The statute says 120 days. Use the stated period and the stamped expiry rather than treating every four-month span as identical.
Does paying for the wedding reserve the licence beyond expiry?
No. Private payments and booking arrangements do not extend its legal life.
Can we write the earlier date on the certificate after postponing?
No. The certificate must record the actual ceremony. Backdating is not a way to use an expired licence.
